Just curious why you would put your crypto in the custody section of Celsius. With your strict rules on crypto investing that seems really risky. Anyways great video!
The answer to the last bullet point hinges on the first: "Are the crypto assets in Celsius possession property of the estate."
1. You need to clarify the estate of which Celsius entity are they referring to?
2. Did they disclose this in their terms and conditions?
If yes then Celsius have a claim and if no then Celsius does not have a claim. Should it turn out they do, then you can counterclaim you did not fully comprehend the terms, nor the scale of the risk involved, and if Celsius did not make this clear upfront, then raise this as an issue, and counter-claim against Celsius for mis-selling products and services.
And I would also question the following and raise these as possible issues:
1. Was Celsius indemnified against such loss and if not why not?
2. Was Celsius being prudent or irresponsible in how it was conducting business?
3. Should it turn out they are not insured to cover the loss and should it turn out they were irresponsible, then you could take a private action against them, as a "public interest" concern.
This is what I would do, if push came to shove.

My understanding of what Simon said about filing… was that that it wouldn't be productive to file for the Creditor's Committee if your account is under $1 mil. I'm thinking the available claim form is for "lesser" depositors, shareholders, etc.? Or is any filing under $1 mil useless?

If we all went to the bank and withdrew most of our money the banks would collapse but they have insurance. Celsius collapsed after much FUD was spread about them which has caused this situation. I lost, we all lost but Im more inclined to blame the people who engineered this at the start for their own personal gains. Thank you Mr Keiser.

one correction… 17:46 you misspoke… the EARN portion of the pie chart is 77%. That is huge! Celsius is saying they have rights over 77% of the assets… (if you include the Lending Collateral… that is an additional 15%.). Basically, only 4% is in Custody accounts which the Customer has rights to, according to the Terms and Conditions you spoke about at 21:55
I’m so thankful my dad is a very cautious man and did not take my advice to take money out of his savings and put into celsius. I believed in this company and wanted my dad to have an easier retirement. I’ve been hit hard but wouldn’t have forgiven myself if I’d put my dad in the position I currently face 🙏 fcuk Mashinsky and everything he ever did or said.
